I would suggest adding the tricky word to MS Word's dictionary, but that guarantees that the instance of the word you add will itself be misspelled, resulting in your misspelling of all other instances.

I like the result, but calling this an “emergency rulemaking” is a little hyperbolic, no? EOIR relied on the APA exceptions for procedural rules and foreign affairs functions, rather than the aspect of the “good cause” exception that applies in emergency circumstances.
Have a link to the complaint by any chance?

In both his series, Islington starts out pretty well but then rapidly declines. And more generally with respect to Hierarchy, the “dark academia“ trope cannot die soon enough.
This is fine, but seems to ignore the existence of *linguistic* canons, which are much less problematic in squaring with textualism that substantive canons. Also, it says Kagan dissented in the tariffs case.
You need to remember your own rule that the reality will be 4x dumber than you expected!
*Authors. Autocorrect editing fail on my part.
Don’t forget artists and inventors in Article I.
“As noted in our comments on the previous draft ….”
Next time some asks for an example of "a distinction without a difference," I'll have something new to which to refer them.
Isn't it irrelevant for purposes of challenging the rule that the APA doesn't apply to the President? The APA claim runs against the agency implementing the presidential directive--here, OPM.
Big conflict of interest, too. How do you zealously defend your client (the U.S.) when the plaintiff will fire you for doing a good job?
Didn’t have to open the link to know the author. *sigh*
You speak as if SCOTUS still had legitimacy after their weak-willed kowtowing to the big "administrative claims processing" lobby the past two decades.
This would fit perfectly in a classic episode of Frasier, which I hope you understand is high praise.
We have entered Youngstown Zone II: the Twilight Zone
Pillars of Eternity II: Deadfire is excellent for RPGs—it’s more similar to BG1 and BG2 than BG3, graphically, but it’s got lots of world-building, and your decisions have a big impact on how the story resolves.
Including “likely” is a result only of the procedural posture of the case. At this stage of the case, the relevant legal question is who is likely to prevail—there is no need yet to definitely resolve the legal questions. That comes later in the litigation.
I dont necessarily disagree, but...."In September 1791, the commissioners named the federal city in honor of Washington and dubbed the district in which it was located the Territory of Columbia."
And to answer the question: I have not read the book, but I read One First consistently. As you may have guessed from my first comment, I think your rhetoric about the Supreme Court is overheated at times, but I do genuinely appreciate the substantive analysis.
Are you implying that the content of a book (or a blog) is more important than what the book (or the blog) is titled?
“The Shadow Docket: How the Supreme Court Uses Stealth Rulings to Amass Power and Undermine the Republic.”
And yet you have qualms about a lack of neutrality?
An empirical comparison of how often judges rule in a way consistent with the party of the President who appointed them (e.g., rule for gov't during Republican admin if appointed by Republican) pre- and post-filibuster would be fascinating. @chrisjwalker.bsky.social?
Don't forget anti-science and anti-medicine.

Come for the APA claims, stay for the 42-page state standing analysis regarding downstream effects of the MAHA certification for single Turkey on the Minnesota poultry industry.
Good tip, but just don’t forget to delete the extra 32674 lines between paragraphs that copying and pasting to Outlook will inevitably insert.
This sounds very on brand for an administration that also believes Antifa is a literal organization.
