The imprecise test in the Courts and Tribunals Bill, by which the government intends to remove the right to jury trial from all those who β€œwould be likely to receive a sentence of imprisonment or detention of more than three years for the offence or offences (taken together)” will itself take up valuable court time. First, in deciding this question, the court must hear representations from the prosecution, the defendant and any co-defendant and have regard to any relevant sentencing guidelines. It must then give a reasoned ruling (which cannot be appealed).

More significantly, if at any point during the trial there is any change in either the defendants to be tried, or the offences for which they are to be tried, or there is β€œnew evidence that would or might affect” whether the original test had been met, the court must revisit it and in an appropriate case order trial by jury: the original judge-only trial will be aborted and a second trial will take place. This will have serious consequences, not only by causing further delay and increasing court time and costs, but also in human terms for witnesses and defendants. No doubt, evidence given in the first trial will be used to test the evidence in the second. None of these implications appears to have been considered.
