If such litigation does not happen, the Organization has all interests to consider moving away from that host country. It will be a financial loss for the host country, especially for the headquarters of the Organization. And there is no doubt that other Member States would gladly welcome it.
The affected individuals do not have any judicial avenue against this discrimination which goes against the foundation of the UN Charter. Either the host country respects the agreement with the organization, or the Organization initiates legal proceedings to ensure enforcement of the agreement.
Second, and on another front, the #USGov has been harassing staff members of the Secretariat holding certain nationalities. In my practice, I am aware of such abuse against Russians. Here is the latest judgment from the United Nations Dispute Tribunal (www.un.org/en/internalj...).
In my humble view, two elements could have reinforced the argument. First the fact that the US Gov refused to grant a visa to Palestine Leadership to attend the General Assembly General Debate. Resolution 80/1 (docs.un.org/en/A/RES/80/1) is not sufficient. Not new though. But who will be next?
