Definitely. They could have just said that, but why make things simple? (Although in my head, β€œI read the instruction manual” conjures images of assembling IKEA furniture and having a few nuts and bolts left over, which is kind of how these laws are being assembled, so I’m partial to that.)

The requirement to β€œknow how” to interpret the findings is … a choice. What’s the standard of knowing how? Are we talking, β€œI read the instruction manual,” β€œI just figured it out,” β€œit’s how we’ve always done it,” or β€œI built the system?”

Yes. And regardless, the collection and processing needs to be legal to start with. Which typically means you’re not keeping it longer than needed to provide the service and with students, not using it for any other purpose (at least in US K12). Thus, it’s long gone before the student gets older!

Interesting! Don’t know if voice changes are such that a voice of a child couldn’t be connected to the same child as an adult. However, if collected, used, and retained lawfully today, it means the voice will have been deleted long before anyone has a chance to find out! (And 100% to no cloning!)

Unfortunately, I believe poor drafting leading to opposition from big tech + ACLU and other consumer advocates left it doomed from the start. The edits helped some, but by then the damage (and the delays) had been done. May have passed swiftly if better done from the start.
