Illuminate Education faces lawsuit alleging failure to keep user data in the dark - Daily Bruin
The California Supreme Court will soon decide the scope of two education data privacy laws. An appellate court ruled in July that the case J.M. v.
CA Confidentiality of Medical Info and CA Customer Records Act have entered the student #privacy chat. One to watch, esp for those working w/ district SEL programs, IEPs,
etc. And remember:
notification 5 months after a breach (w/out good reason) is a VERY expensive, self-inflicted wound. #edtech

Yes. And regardless, the collection and processing needs to be legal to start with. Which typically means youβre not keeping it longer than needed to provide the service and with students, not using it for any other purpose (at least in US K12). Thus, itβs long gone before the student gets older!

Interesting! Donβt know if voice changes are such that a voice of a child couldnβt be connected to the same child as an adult. However, if collected, used, and retained lawfully today, it means the voice will have been deleted long before anyone has a chance to find out! (And 100% to no cloning!)

IXL class-action suit advances amid student data harvesting claims
A group of parents allegesΒ the ed tech providerΒ collected and monetized data from millions of school-age children without parental consent.
This lawsuit seems messy. Plaintiffs seem to ignore #FERPA & cite basic analytics and adaptive learning as some of the nefarious doings with data. Defendant's tilting at #COPPA is...unique. TBD if it prevails on wiretapping or other, but one to watch. #privacy #edtech @annamerod.bsky.social

Unfortunately, I believe poor drafting leading to opposition from big tech + ACLU and other consumer advocates left it doomed from the start. The edits helped some, but by then the damage (and the delays) had been done. May have passed swiftly if better done from the start.
