Next Tuesday, 3/17 at noon ET I will be speaking on this panel hosted by the DC Bar on the #ftcvmeta trial that I attended last year for the Big Tech on Trial Substack. There are great panelists including @tarap.bsky.social Dan Gilman, Joseph Coniglio & Justin Katz
4/ @evanbernick.bsky.social and I have posted our amicus brief, "An Originalist Defense of Birthright Citizenship" on SSRN, with our deepest gratitiude to @brendanbenedict.bsky.social & @mike-altebrando.bsky.social as our counsel who added so much substance:

In a brief from the originalist legal scholars Evan Bernick and Jed Shugerman, the authors argue that Trump's interpretation of the 14th Amendment is based on dubious claims of the text's original meaning. https://loom.ly/RPK4hdo
Quite proud of this brief I worked onβfiled on behalf of eight immigrant rights orgsβwhich points out the disconnect between the govtβs legal theory of birthright and the terms of the EO, which would affect millions of people with deep ties to our country.

Great brief, really enjoyed reading through this - Very nice work @nbaron.bsky.social and team.
this is a great brief and it appropriately ends with a killshot: the simple observation that if trump's meaning held, the birthright clause would not have overturned dred scott, the one thing it was absolutely meant to do.
Thank you, Akiva.

I'm really proud of our teamwork here. I love this closing paragraph (and I didn't write it, nor did I write the killer intro, which I also love).
3/ I provide more detailed evidence in support of Part IV in this article, with the support of many legal scholars before me:
"An Originalist Case for Birthright Citizenship:
The Inclusion of 'Temporary Sojourners' and of Chinese and Roma"

Pretty straightforward from here
With the outstanding teamwork with Brendan Benedict and Michael Altebrando, @evanbernick.bsky.social & I proudly filed this originalist amicus brief defending birthright citizenship in Trump v. Barbara:
