Our recommendations are not changed by the Supreme Court judgment. Rather, the judgment removes any possible uncertainty regarding the appropriate target of data collection for the purposes of equalities monitoring on the protected characteristic of sex.
The addendum has been submitted to the Department for Science, Innovation and Technology
We hope it will prove useful for organisations digesting the implications of the supreme court judgment for data collection.
Following the Supreme Court judgment on the meaning of "sex" in the 2010 Equality Act, we have published an addendum to our report on data and statistics on sex and gender.
This explains how the judgment dovetails with the recommendations of the review.
