For those unfamiliar, the Claremont Institute is a think tank that tries to give intellectual legitimacy to the racist underpinnings of policy on the American Right. They promote fringe theories in law and political theory and reject longstanding norms, like that all citizens are equal under US law.
I once told a group of philosophers that a lot of American politics stems from the debate on whether the US should actually follow through on the 14th amendment (equal protection).
They were shocked to hear that American law hadn't accepted the version of the constitution passed in 1868.
