A major question that remains now is how the administration will pay back the duties collected under IEEPA. CBP will likely be inundated with reimbursement requests that will take years to pay back.
Section 122 authorizes country specific tariffs at 15% for 150 days. It is a temporary restriction that has the speed and flexibility IEEPA gave the administration. However, any extension of 122 beyond 150 days would require Congressional approval.
IEEPA tariffs have been struck down but trade lawyers have suggested a potential contingency would be Sec 122 as a temporary measure until 232 and 301 investigations have been completed. We're likely to see a massive shift toward sectoral tariffs.
Potential ruling on the IEEPA reciprocal tariffs coming out tomorrow. While it will make a huge difference in trade policy—particularly if they rule against—it will not be the end of tariffs. We still have Secs 301 & 232 investigations in the pipeline that could have huge implications (i.e., chips).
