Critics Warn FACE Act Enforcement Could Target Political Protesters
ST. PAUL, Minnesota β Debate over the federal Free Access to Clinic Entrances (FACE) Act has intensified following anti-ICE protests that disrupted a church service in St. Paul earlier this year, prompting renewed calls from legal advocates to reconsider the lawβs scope and enforcement.
Congress passed the FACE Act in 1994 to impose penalties on individuals who intimidate, injure, or interfere with access to reproductive health facilities, including abortion clinics, as well as houses of worship. The law was intended to address violent incidents targeting clinics during the 1990s, but critics say it has rarely been applied to disruptions at religious services.
The controversy resurfaced after a January protest involving anti-ICE activists interrupted a church gathering in St. Paul. According to reports, former CNN anchor Don Lemon attended the protest and was later charged by the U.S. Department of Justice in connection with the incident.
Matthew Cavedon of the CATO Institute argued the law may exceed federal authority. βI am skeptical that there is enough of a breakdown in law and order at the state level to justify this becoming a federal crime,β he said.
Erin Hawley of Alliance Defending Freedom said the law has historically been used more aggressively against pro-life demonstrators outside abortion clinics. Federal data show the Biden administration charged 24 people under the FACE Act over four years, with 22 cases involving pro-life activists.
Supporters of reform say the law risks uneven enforcement depending on which party controls the federal government. Some legal advocates are urging Congress or the Supreme Court to review the statute and clarify how it should be applied to protests involving religious institutions.

Boston Judge Blocks Trump DHS Effort to End Somali TPS
BOSTON, Massachusetts β A federal judge has temporarily blocked the Trump administration from ending deportation protections and work authorization for nearly 1,100 Somali nationals living in the United States under Temporary Protected Status (TPS).
U.S. District Judge Allison D. Burroughs issued the order Friday in Boston, pausing the Department of Homeland Securityβs decision to terminate TPS protections for Somalis that were scheduled to expire on March 17. The ruling preserves the legal status of the beneficiaries while the court reviews a lawsuit challenging the policy change.
Burroughs wrote that allowing the program to end immediately could create βweightyβ consequences for Somali immigrants who rely on TPS. According to the court filing, plaintiffs warned that losing protections could expose recipients to detention, deportation, violence in Somalia, and family separation.
Four Somali nationals, along with advocacy groups African Communities Together and the Partnership for the Advancement of New Americans, filed the lawsuit arguing that the administrationβs decision was procedurally flawed. They also alleged the move reflected bias rather than a neutral assessment of conditions in Somalia.
A spokesperson for the Department of Homeland Security criticized the ruling, calling it another example of βjudicial activistsβ interfering with the administrationβs efforts to change immigration policy.
Temporary Protected Status is a humanitarian program allowing migrants from countries experiencing armed conflict or natural disasters to live and work legally in the United States. The Trump administration has moved to end TPS designations for multiple countries, prompting several ongoing court challenges.
The administration is also awaiting a U.S. Supreme Court decision on similar TPS cases involving Haitian and Syrian nationals.
