🚨 Wyoming’s Governor signed into law a so-called “fetal heartbeat” abortion ban

Abortion is now banned in WY when “cardiac activity” is detected, about 6 wks of pregnancy

WY now shifts from a “Restrictive” policy landscape to “Very Restrictive”

An Editorial note (for myself) - the research shows that most adolescents have developmental capacity to make independent health care decisions broadly (not focused specifically on abortion)

Such a pleasure speaking to @carrienbaker.bsky.social and @msmagazine.com about our research - new in @jamahealthforum.com !

This piece also has key information on the history of parental involvement laws - and links to the excellent @hrw.org report on the harms of such laws.

215. The Supreme Court and Vietnam The obstacles to litigating the grave legal questions arising from the United States' military operations against Iran can be traced to the Court's refusal to confront similar questions about Vietnam.

It may seem odd that a Supreme Court seemingly willing to stick its nose into the middle of just about every legal and policy issue has effectively closed the door to litigating the legality of the U.S. war against Iran. As today’s “One First” explains, though, it set that precedent during Vietnam:

screenshot of legal document filed by Trump's FDA with two sections highlighted in yellow, denoted by double asterisks:
Approval Suspension. The provision of the Federal Food, Drug, and Cosmetic Act that specifies the circumstances in which a drug application can be withdrawn, 21 U.S.C. § 355(e), includes authority to suspend an application prior to its withdrawal. In particular, **if the Secretary of Health and Human Services 1 [refers to footnote 1] finds that a drug presents “an imminent hazard to the public health,” he may suspend the approval of the application (including a supplemental application) “immediately.”** 21 U.S.C. § 355(e). The Secretary then must “give the applicant [aka the drug manufacturer] prompt notice of his action and afford the applicant the opportunity for an expedited hearing” on whether to withdraw approval. Id. Approval may be withdrawn if, among other things, “new evidence of clinical
experience . . . evaluated together with the evidence available to [FDA] when the application was approved, shows that such drug is not shown to be safe for use under the conditions of use upon the basis of which the application was approved.” Id. § 355(e)(2).
Apart from the Secretary’s suspension authority, there are no “interim orders” FDA could issue. However, FDA possesses authority to require a sponsor to propose changes to a drug’s conditions of use, including by adding or modifying a REMS requirement related to prescribing or dispensing. The timing of implementation is...
Footnote 1: Although the Commissioner of Food and Drugs generally “execut[es]” the Secretary’s authorities under the Federal Food, Drug, and Cosmetic Act, 21 U.S.C. § 393(d)(2), **“the authority . . . to suspend approval of an application”—as distinct from withdrawal of approval—“shall not be delegated” and remains with the Secretary**, id § 355(e) (emphasis added)

NEW: The FDA just outlined the ways it could restrict the abortion drug mifepristone during its horseshit "safety" review. The first? RFK Jr. has the power to immediately suspend the approval of drugs that he deems “an imminent hazard to the public health”

I truly do think all of the "Noem out, Mullin in" posts and stories are failing American democracy right now!

Trump is announcing his nominee.

That's it.

If the Senate majority wants to confirm him, they're a part of this—even after knowing what they know now.

And that matters come November.

Trans Kansans are Right to Distrust Federal Courts Transgender Kansans are challenging a new discriminatory law in state court, refusing to leave their freedom up to an untrustworthy federal judiciary.

Two Kansans are suing in state court over the new law invalidating trans people's licenses & deputizing bathroom bounty hunters

And they're arguing on state law grounds alone

Kansas's anti-trans law violates federal law too, but federal courts can't be trusted

This is a good example of the alternate civic sphere they have built. Their own institutions credentialing almost entirely for signal instead of skill. It’s not strange historically. Think being a member of a faith to become a professor at religious institutions.

Connecticut General Assembly The Connecticut General Assembly 2026 Regular Session convenes February 4th, 2026 and adjourns May 6th, 2026

Not Connecticut (a pro choice state! *gasp*!) quietly considering parental notification of minors who want to get an abortion 🙄

Time and time again lawmakers are willing to compromise on the human rights of young people
