As much as this Supreme Court hates parts of the Constitution, you do have a constitutional right not to be punished except for upon conviction of a crime by a jury of your piers, and therefore the burden of proving that you're not entitled to bail is *on the government*

I think the statute has already been interpreted as co-extensive to the First Amendment, hence the true threat language.
We are not far away from "punching Nazis is a good thing" getting people jail sentences.
This decision is obviously and egregiously incorrect, but it goes to show that you have to be really careful using political hyperbole in a world in which the First Amendment is extremely malleable along political lines.

The felony murder rule is stupid and the idea that somebody would get the death penalty because of it would be morally abhorrent even If the felony murder rule wasn't stupid and even if the death penalty wasn't morally abhorrent on its own. Any conversation about "innocence" misses the point.
