Other than arson, maybe, I don't see any circumstance in which it makes logical sense to execute someone for murder when they did not, in fact, murder anyone. Especially in cases where the actual murderer does not receive the death penalty.

a reasonable exception, I think the felony murder rule should be abolished. The state needs to prove an intent of the co-defendant to commit murder. The mere risk of death would be negligent or reckless homicide. This is especially true in states with the death penalty.

I think you have a misunderstanding of what felony murder is. In your examples, compared to this case, it would be someone else burning down your house or gagging the victim WITHOUT ANY PROOF OF THE DEFENDANT'S knowledge. And there are plenty of felony murder cases where the Defendant's involvement
