The White House could certainly claim this. But Congress explicitly stated in the war powers resolution that appropriations do not equal authorization to use force and should not be interpreted as such.

This is the f’ing way. Every one of the those wrongly detained should be suing the federal government, as well as individual members of the administration by name. It’s one of the only major avenues of recourse that might affect change in the admin’s behavior.
