Page 1 of 2 of the text of Georgia Senate Bill 120 Senate Bill 120 By: Senators Harbin of the 16th, Gooch of the 51st, Burns of the 23rd, Albers of the 56th, Ginn of the 47th and others A BILL TO BE ENTITLED AN ACT To amend Article 1 of Chapter 1 of Title 20 of the Official Code of Georgia Annotated, 1 relating to general provisions relative to education, so as to provide that public schools, local 2 education agencies, and public postsecondary institutions shall not promote, support, or 3 maintain any programs or activities that advocate for diversity, equity, and inclusion; to 4 provide for sanctions; to provide for definitions; to provide for related matters; to provide for 5 an effective date and applicability; to repeal conflicting laws; and for other purposes. 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 7 SECTION 1. 8 Article 1 of Chapter 1 of Title 20 of the Official Code of Georgia Annotated, relating to 9 general provisions relative to education, is amended by adding a new Code section to read 10 as follows: 11 "20-1-12. 12 (a) As used in this Code section, the term: 13 (1) 'Local education agency' shall have the same meaning as set forth in Code Section 14 20-2-167.1. 15 (2) 'Postsecondary institution' means a school which is: 16 S. Page 2 of Georgia Senate Bill 120 25 LC 61 0068 (A) An institution of the University System of Georgia; or 17 (B) A unit of the Technical College System of Georgia. 18 (b) No public school, local education agency, or postsecondary institution shall promote, 19 support, or maintain any programs or activities that advocate for diversity, equity, and 20 inclusion beyond upholding the equal protection of the laws guaranteed by the Fourteenth 21 Amendment to the United States Constitution and Article I, Section I, Paragraph II of the 22 Georgia Constitution. 23 (c) Any postsecondary institution that violates subsection (b) of this Code section shall be 24 subject to the withholding of state funding or state administered federal funding. Such 25 withholding of state funding or state administered federal funding shall include funds 26 provided to the postsecondary institution directly as well as funding for scholarships, loans, 27 and grants pursuant to Chapter 3 of this title for students of such postsecondary institution." 28 SECTION 2. 29 This Act shall become effective on July 1, 2025, and shall apply beginning with the 30 2025-2026 school year. 31 SECTION 3. 32 All laws and parts of laws in conflict with this Act are repealed. 33 S.
