The public interest likewise favors ensuring that governmental power is exercised only by officials with lawful authority. Each factor, and all four taken together, weigh against granting a stay.

To emphasize: Trump's Board of Immigration Appeals (I call it that because they purged almost everyone else) is saying that even people who are 100% certain to get a green card if the government just waits a few years should instead be ordered deported because there will be an "uncertain" wait time.

In 1990, when Congress created a protection for migrant children subject to abuse, it didn't anticipate backlogs would get bad enough that beneficiaries would wait years for a visa, and so never thought to explicitly bar deportation for winners.

Today the BIA greenlit deportation in that situation.
