Lastly, our comprehensive βYear in Review 2023β, authored by BelΓ©n Guerrero Romero, Wamika Sachdev and Baptiste Beurrier, offers a detailed compilation of significant IHL/LOAC developments that took place within 2023.
Prompted by the war in Ukraine, Robin Sinnige then explores when support, and specifically the provision of processed satellite imagery, might render a third state a co-party to an armed conflict, proposing a three-part test (extent, causality, and intent) to clarify this legal grey area.
In the general section, Neil Davison traces the decades-long effort to close a key loophole in the 1993 Chemical Weapons Convention regarding the use of toxic chemicals for law enforcement, culminating in a 2021 clarification banning aerosolised central nervous system-acting agents.
Then, Oscar A. Gomez, using the case of Colombiaβs well-developed state humanitarian agencies, argues that the state should be recognised as a central humanitarian actor, beyond the usual roles of the benevolent funder or the helpless receiver.
The first piece, authored by David Matyas, calls for a rethinking of humanitarian assistance law from the perspective of humanitarian practitioners to better reflect the practical realities and legal challenges faced by humanitarian actors.
