I think the big obstacle in the US, honestly, is the extreme elitism in the legal academy. Relying on student editors from elite schools feeds into that.

I also think moving to peer-review wouldn't involve half those things. In other countries, legal academics are expected to get PR articles not student-editted law reviews. All it takes is shifting norms around hiring/promotion. 1/2

Elite institutions seem to impart to their scholars a license to just shoot from the hip. Occasionally leads to interesting talks. Often leads to just ridiculous nonsense.
