The First Amendment is my absolute passion.
Virginiaβs proposal is particularly non-sensical. Not to mention onerous for services with significant (or exclusive) web traffic where usage tracking is difficultβif not impossible.

Seems like an unlikely caseβthe response highlights that the 230 argument was not developed below so would not be properly before the court here.
If SCOTUS takes a 230 case they probably want it to be a clean vehicle, unlikely to be this one from my POV

I draw comfort from Kavanaugh saying that *all* the injunctions weβve gotten so far are correct *and* we should win here.
This is a tragedy -- not just for a growing concern like Bluesky -- but for all the Mississippi users who have found a sense of community or belonging on the site.
In addition to their other flaws, these laws absolutely destroy important resources for people to foster and maintain their communities
This is something that absolutely breaks my heart.
To be clear, the injunction still *exists* it's just not effective right now.
Briefing is underway to see how the Fifth Circuit will ultimately come out on the question of whether to keep the injunction or not. (Not a huge comfort to folks facing enforcement I'd imagine, just wanted to flag.)

Once again, Mississippiβs access restriction and censorship law is preliminarily enjoined! The district court issued a second injunction today after the case was remanded from CA5 earlier this year.

Indeed. Freedom of speech requires the ability to offend and desecrate the symbols of freedom.
Without that ability, freedom would be illusory.
The State would be empowered to compel allegiance, professions of belief &c.
The First Amendmentβs guarantees are not so easily brushed aside.
It would at least stop a lot of the awful stuff being proposed at the moment.
Letβs see if it stays!
