I think this does qualify as an exceptional failure in civil-military relations. If asked to do something clearly within the purview of Article I authority, is there not an obligation to check with Congress first?

Given that being in such a predicament in the first place is a sign that things have gone terribly wrong, a wiser set of US military leaders who took their oaths to the Constitution seriously would have already developed a much stronger and more active relationship with Congress than what exists now
