Trump has repeatedly said Republicans would β€œnever lose a race. For 50 years, we won’t lose a race.” The fact that he would try to unilaterally (and unconstitutionally) put policies in place which he has explicitly stated would benefit his party is a clear sign to all Americans (including judges) that any EO including such a policy is not about election integrity at all but instead about election manipulation.
His last attempt to take over elections in 2025 failed when a federal judge said, β€œOur Constitution entrusts Congress and the Statesβ€”not the Presidentβ€”with the authority to regulate federal elections,” and β€œ[N]o statutory delegation of authority to the Executive Branch permits the President to short-circuit Congress’s deliberative process by executive order.”
No judge is going to side with him on this. Elections carried on without presidential intervention during the Civil War, both world wars, and all of the more recent military action in the Middle East. Even in 2020 when we were under a real national emergency of COVID, states still carried out elections unimpeded.
And on top of that, any attempt by Trump or the executive branch to rewrite election administration and voting laws (for more than 10,000 election jurisdictions across the country) in response to alleged foreign interference would be unprecedented, illegal, and a clear attempt to create chaos and prevent American citizens from exercising their constitutional right to vote.
