The Missouri Republican who introduced this bill is now running for Congress against Emmanuel Cleaver in the newly gerrymandered US congressional district. He's one of the most extremely bigoted and profoundly stupid elected R's in the state.

Worrisome that Kobach did not address single-subject challenge much, and the judge did not press Kobach hard on it. I think single subject is the best shot plaintiffs have at getting a TRO, I don't think the judge will go there on the other bases. The DOR/Admin saying not adverse to it was helpful

Very strong argument for TRO need is that the unique harm from medical disclosure is a bell that cannot be "unrung" necessitating a TRO. If KS tried to phase this in over months, very different.
Judge asks a great Q. Lot of states don't have sex designations but instead rely on trespassing or assault charges, the conduct of alleged perp rather than just sex-status.

Certainly they went after bathrooms years ago, that's correct. What I meant to say, perhaps unclearly, was they message test these things in statehouses to push them nationwide via Congress. That's what I'm seeing next is a nationwide push.
I truly believe Rogan and others operate from a script. Heritage/ADF have signaled the next push is bathrooms and drivers licenses. Nationwide. This is part of selling it. Kansas was first, now its going forward.

Kansas statutes do not even recognize gender identity on the list of hate crime aggravating factors, K.S.A. 21-6815. The cops and the state will not track what isn't recognized. Prosecutors will not upcharge hate crimes on murder cases for a variety of strategic reasons. Dishonest reporting
To clarify, these bills seem to be disguised criminalization bills. On paper, no associated penalties, but in each scenario the bills advocates defaulted to, "Just call the cops" Cops take people to jail, they do not adjudicate civil matters on the spot. #moleg
