Oh I 10000000% agree. It’s just that punitive measures make the problem worse. Incarcerating Mary Mallon didn’t stop typhoid fever, but it did amplify already prevalent xenophobia intertwined with public health.

The Mann Act is still on the books today, and it should be, but it doesn’t change the history of its abuse against marginalized people.

Another example of a well intentioned law but often flawed execution is the Mann Act of 1910. Meant to combat human sex trafficking of primarily immigrant girls, a lot of men of color were arrested under the same law for having a consensual relationship with a white woman.

And I’m not saying that public health measures should be strictly informative or educational. There’s still a duty to protect others, but criminalizing disease transmission will arbitrarily target folks who are already vulnerable. It’s literally eugenics. This is eugenic thinking.
