The agreed-upon Findings of Fact and Conclusions of Law find that the original defense attorney was ineffective for failing to investigate the nature of the relationship, where there was evidence of grooming and sexual assault by the decedent to Stewart.

Stewart was 18 years old when he was convicted of manslaughter and robbery for killing his former 7th-grade music teacher and then robbing him of a VCR. He received a sentence of 20 yrs for manslaughter and 60 yrs for robbery.

Defendant Alvin Stewart cries after learning he will be eligible for bond during his hearing in Judge Karen Sage's 299th District Court in Austin Thursday. Judge Sage ruled Stewart can be released on a $1 bond while the Texas Criminal Court of Appeals determines whether to retry or resentence him.
