And if Congress ever legislated on the matter in good faith (I know, I know), it seems obvious that there should be a distinction made between land border areas, rivers, etc. where crossing is a realistic possibility and frickin oceanic coastline.
Have seen a number of people (astutely) post the 100 mile border zone map which rings the country as a refutation of the second idea. But it's worth pointing out that border zone is the creature of regulation and a bad SCOTUS decision; Congress has never actually taken the matter in hand afaik.
