This research moves past local explanations to show how judicial independence has become a central "cultural battleground" in world society today.
Mainstreaming the attack: Practices like "court packing" (adding judges for political reasons) are moving from the illiberal fringe into the mainstream, appearing even in countries previously considered democratic strongholds.
The postliberal era: Since roughly 2008, the gap between liberal and illiberal alignments has widened, with attacks on the judiciary becoming more synchronized across different regions.
States embedded in liberal international networks tend to maintain higher judicial autonomy, while those linked to illiberal organizations show significant signs of erosion.
A Growing Global Divide: Using data from 156 states, I found that judicial independence is increasingly tied to global cultural alignments.
While the 20th century saw a worldwide expansion of independent courts, that trajectory has recently come under intense pressure from governments worldwide.
Happy to share my latest research!
