The Federal Vacancies Reform Act requires the first AUSA to step in after Siebert resigned/got fired. If POTUS does direct someone else to serve in the role of US Attorney, that person had to have served in a position in that same agency (i.e., the EDVA US Attorney's Office) for at least 90 days.

They're seeking dismissal of crimes discovered by the hard work of the FBI after J6 so long as those crimes discovered were not against children. The trend is the DOJ is dismissing derivative gun charges, but not child pornography. Classic "have your cake and eat it, too" argument from the new DOJ
