Dear Gareth, Thank you for outlining the government’s policy. As a human rights lawyer, I am already very familiar with it. I would like you to ask the Minister to reject the EHRC draft Code of Practice, as it contradicts the government policy you have described and is unlawful. While that is my primary reason for writing, there is also an urgent matter arising. You stated that trans people remain entitled to protection from harassment. However, this is not the case in schools. Pupils have no redress under the Equality Act 2010 for harassment related to sexual orientation or gender reassignment. The Department for Education is now consulting on imposing a “bathroom bill” on the basis that no such redress exists. It is plainly sexual harassment and incompatible with Convention rights to personal development under Article 8. This is unacceptable, and I await your comments. Kind regards, Ash Lee
