I talked to dozens of experts in government, academia, cybersecurity, and industry about exactly this scenario last year and not only did not one of them think I was being alarmist, many brought it up unprompted and many said there was zero chance it hadn’t already happened
I’ve said it before, but People magazine should get a Pulitzer for its coverage of this administration.

I guess today is the day I'm going to find out how the LinkedIn algorithm feels about direct discussion and descriptions of adult products, lol! Let's find out if anyone can actually see that adult product focused new trademark scam post I just shared or not.
Perhaps they could do a descriptive/generic refusal, since these are showing adult product drawings for use as logos with adult products? None of these have been examined yet though, so we'll have to wait and see.

Since there's a much closer match between the depicted product and the goods they're used on than the prior examples I looked at though, I feel like it may be harder for the Trademark Office to issue a Failure to Function - Drawing of Nonrelated Goods refusal in these.
These actually depict products which, I believe, are themselves Adult Products, and are listed for use with other Adult Products. Again though, the applied-for marks are being used as if they were logos, on boxes for products just different enough to not be exactly the same thing.
I've been digging into this issue a bit more, and have found several more examples of this phenomenon.
I've also found an interesting subcategory of this new style of scam that I'm going to refer to as....the Adult Section.

I thought it was a trade dress registration at first but then @trademarksaremagic.bsky.social gently corrected me.
The registrant used it to do an Amazon takedown.
I've seen several specimens in applications like this now! The exact ID manual wording is truly very strange.
This recent thread from @design-law.bsky.social adds to the post I shared earlier about a new scam focusing on registering designs of products AS logo trademarks at the USPTO - seems like those are being used for trademark based takedowns of those /actual products/ online.

-App. No. 99501533 is for a mark which looks like ear plugs (of a style sold by Loops) for use with “Massaging apparatus for personal use; Vibromassage apparatus; Massage mitts; Massage apparatus.” The specimen submitted shows the mark on a box for a massage gun. It hasn’t been examined yet.
It looks like there’s a new scam running over at the Trademark Office. I’ve found numerous apps to register trademarks which, at first glance, look like configuration marks, but are clearly just design marks which are slapped on a box for unrelated goods.

Also yeah, while HHS has over 200 live trademark registrations or applications at the USPTO, they don't have any for MAHA or any variation thereof they I can tell.
1. TM means that they're claiming it as a trademark but It doesn't necessarily mean that they've filed an application to registered as a trademark or registered it.
2. Also the federal government can definitely own trademarks and trademark registrations. I think you may be thinking of copyrights.
