2. The full scope and implications of SEC v. Jarkesy-and, specifically, its relevance for the AWA-are still open questions. There are good reasons to think the AWA context is distinguishable. But the USDA is taking a cautious approach, presumably pending DOJ guidance and further clarifying case law.
1. Most birds--that is, birds bred for research--still aren't covered by the AWA. So the >63k birds the USDA is now overseeing are the tip of the iceberg--the birds *not* bred for research who are being used (e.g., the wild birds scientists are capturing and then subjecting to experiments)
