Whilst I agree with your premise, the problems with the implementation around consistency etc would be very problematic......especially when it comes to things like lap/sector lengths/circuit recharging ability etc wd be 2 much 2 bare!

They wouldn't have needed to do it if they just allowed unions to organise freely in every workplace no matter the current numbers of members, and forced all employees to recognise and negotiate with all Trade Unions with members in their organisation. If they did that the law would do the rest
But you need the support to understand that and do it if you are a low paid worker - probably not well educated and possible with language barriers - then who is going to tell you.....a union rep might......but if you don't have day 1 protection then are you going to be around long enough to meet 1?
I now work for a HR/HS consultancy (on the HS side) and they are pushing how bad this is for employers from a HR side (thats how I know its good) but it should have been so much better if they'd had some guts instead of giving in to CBI lobbying and then right wing press...but that's Starmer & Kyle!
If they really wanted to strengthen employment rights they would have stuck with Rayners bill and added in the part about terms and conditions being linked to provider agreements. This would have givje these workers the auto recognition and support they need.
But they abandoned what they had.......as soon as Rayner was out the door, Peter Kyle and the rest started meeting CBI lobbyists and watering it down......they caved.....not enough for any Labour MP to notice until these people start turning up in their surgeries asking 'why didnt you stop this?'
Not if they are employed for less than 6 months........the Act does not allow them to take a claim to ET.....even for protected characteristics. They could sue for civil damages but they would need a trade union to help with this and non of these workplaces are unionised so no one would back them
But not those who are most at risk. I can tell from your answer you have never done either of these 3 things:
1)Represented lownpaid workers in non official unionised workplaces
2)Dealt with/advised public sector contractors.
I have done both of these and the ppl who run them are profiteers
What we need to do as a country (and Labour needs to do as a govt) is to state that the terms and conditions for employees of any contracted/outsourced services provider need to be the same or better than those of the body the contract is with. This would prevent the exploitation I am talking about!
Also if their boss discriminates against them (or abuses them) and they if they complain and are dismissed, they will not have any protection. The issue I have with the new act is that it protects those who work where good practises are already in place but doesn't prevent this kind of exploitation!
If they are in work for less than 6 months and are dismissed thrn they cannot take the employer to tribunal. I have represented these people as a union rep and I can tell you this is exactly what privatised care and cleaning company owners with these contracts will do.....becaise they can!

But notnif you work for a private provider of outsourced services within the public sector as care workers and cleaners will have their contracts rewritten so they never reach 6 months service
