We think it needs to be amended before it is signed into law and there is still an opportunity to do so this year.

If Virginia wants ranked ballots that are fair, easy to understand, and trusted by voters, the current bill needs one simple amendment. I break down what that change is and why it matters in todayโ€™s Virginia Pilot: www.pilotonline.com/2026/02/24/c...

From 1982-2018, the Republican National Committee was barred from "ballot security measures" because of their record of using state actors to intimidate minority voters.

But the defendantsโ€™ threshold arguments falter with respect to the plaintiffsโ€™ challenges to Sections 2(a) and 2(d). And on the merits, the plaintiffs are substantially likely to prevail: Our Constitution entrusts Congress and the Statesโ€”not the Presidentโ€”with the authority to regulate federal elections. Consistent with that allocation of power, Congress is currently debating legislation that would effect many of the changes the President purports to order. See Safeguard American Voter Eligibility Act, H.R. 22, 119th Cong. (2025). And no statutory delegation of authority to the Executive Branch permits the President to short-circuit Congressโ€™s deliberative process by executive order.

The district court's opinion partially & temporarily blocking key parts of Trump's executive order on elections is careful, persuasive, and seems very likely to be upheld on appeal, even before this Supreme Court. The key point: Presidents don't have authority to regulate federal elections:

A lot of questions about the poll, but why are folks (1) asking people about agreement or disagreement with statements on a 100 point scale, and (2) then dichotomizing that scale, and (3) using the value of 61 rather than 50 to split agree and disagree?
