The eBikeβs top speed capability should be irrelevant. When I lived and drove in Europe, and had exited the speed-unlimited portions of the Autobahn, I didnβt have to get out of my car and walk entering small towns - I just had to drive below the relatively low speed limit.
I think it probably derived from eBike motor control systems being digital, though you certainly could have built them using analog systems, tiny digital computers are just the norm now. βPure mechanicalβ would have been more accurate for the traditional bike, but weβre all digital babies now.

Federal law classifies them as *not* motorized vehicles as long as they meet well defined limitations. This allows their use on trails, etc. though the hodgepodge of local regulations across the country complicates that. Thereβs been little effort to prevent buying noncompliant or modified ones.

Owners arenβt leaving eBikes just anywhere - itβs rude uncaring riders, and they will stop when large deposits become required to rent the things, leading to them being less accessible to many. The same tragedy of the commons events are occurring with Waymos and such with doors being left open.

Legal definitions of eBikes do not require no throttle, but maximum speeds.
Watts are not what determines the top speed of eBikes, just how quickly they can get there or can hold it.
