The rulings in those cases have come from 39 different judges appointed by 5 different presidents (of both parties) to 11 different district courts across 7 different circuits.

This dissent is spot on. Military medical staff providing routine, non-battlefield care should not be exempted from tort actions. Too many examples (personal and anecdotal) of SMs injured from undertrained or overly creative practitioners. This exception should be eliminated or narrowed.

Based on the planting strip “buffer,” the process almost certainly was (1) build car lanes (2) build sidewalk with buffer so inevitable car crashes hit peds less (3) paint bike lanes but leave buffer (4) pat selves on back.
Solution: buffer the bike lane or widen the sidewalk.

Fascinating to compare two opinions from WA COA Div 1 this week. Both involved WSU and fraternity hazing. Both turned on whether WSU had a duty to monitor. Same facts, different results. The (simplified) distinction is a concession by counsel during OA.
