It is unclear whether one particular photo — or the sum total of the shots on March 2 — led to consternation among Hegseth’s staff. When photographers showed up to the Pentagon for the next briefing on March 4 they were not allowed in the building.

Judge Friedman asked both NYT and DOD to submit proposed orders for a summary judgment ruling. The gov't declined, saying the press policy is "constitutional and not arbitrary and capricious." The NYT submitted a proposed order to strike parts of the policy it thinks are illegal.

The New York Times is back in D.C. federal district court tomorrow morning at 10:00 a.m. in its case against the Defense Department. Both the Times and the government will deliver oral arguments on their respective motions for summary judgment.
