6/10 This can't happen by mistake. Companies can easily avoid to incur in those conditions by making even a limited effort to mitigate methane emissions. In the unlikely case fines are set at a maximum level unlawfully, they can be challenged in court.

1) unequivocally intentional 2) exceptionally serious with persisting effects
The company responsible would need to 3) do nothing to mitigate/remedy damage 4) repeated infringements 5) display full lack of collaboration with authorities
