There will be no Nuremberg type charges/trials. The US isn’t a signatory to the part of the Geneva Conventions re the ICC. So it’s up to the US to prosecute its own β€œwar criminals.” Plus, generally, it was the very high ranking Nazis charged save for guards at death factories, not the little guys.

I think it’s a little much to ask lower ranking officers, NCOs & junior enlisted ranks to risk court martial & imprisonment for disobeying orders - the law requires they presume orders are legal. It’s the upper ranks that should make those decisions.

During my DOJ tenure, I dealt with attorneys who did what this DOJ atty did. On my motions, attys have been barred from practicing in the federal district in which the case was pending; courts have the power to impose sanctions. Then I’d go to the Bar seeking disbarment. I was very successful.
