Applicable because litigation was reasonably foreseeable and because the Federal Records Act independently imposes a preservation obligation on all government employees. They asked the judge to draw an "adverse inference" against the government as a sanction.
The case seems close to a resolution, at least at the district court level. In the past two weeks the plaintiffs filed a motion for summary judgment as well as one for spoliation (sanctions for destruction of evidence): www.courtlistener.com/docket/70035...
If your witness is being questioned about his meetings with counsel, I was taught you generally want to object before you are a dozen questions in.
The government is dealing with very bad facts. Hopefully that will matter.
From the few I have listened to, the DOJ lawyer representing the agency and DOGE witnesses is not very good.
