The proposed rule would be challenged in court immediately..It would do much more than potentially give dept lawyers a free pass to lie on the presidentโs behalf. It would severely limit the courtsโ ability to offer any kind of independent check on executive branch
Such an arrangement would run afoul of fed law known as the McDade Amendment, which says that gov't lawyers are subject to the ethics rules of the states in which they practice, โto the same extent & in the same mannerโ as every other lawyer licensed in the state
โฌ๏ธ
Even so, it seems too few lawyers are willing to take the chance. So Trump admin last week offered up a different solution: a proposed rule aims to shield DOJ lawyers from independent ethics investigations
โฌ๏ธ
To fill empty seats, DOJ has begun a desperate effort to recruit hires. (โDonโt be scared off by the transcript requirementโ a conservative law school reportedly told its students. โG.P.A. is not a strong factor.โ)
โฌ๏ธ
It shows: Briefs are riddled with errors. Lawyers come to court grossly unprepared. Court orders stand violated โ it seems because there arenโt enough lawyers available to ensure they were carried out
โฌ๏ธ
Under pressure to ignore a range of ethics rules, large # of DOJ lawyers have quit, opting to lose jobs but save their careers. Between these departures & purge of legal staff members seen as insufficiently loyal to Pres agenda, dept has lost 1000s of lawyers
โฌ๏ธ
Pres, broadly speaking, lying isn't against law.. lawyers pursuing presidentโs agenda, itโs a different story..lawyers licensed to practice in US, if they violate legal ethics rules, can face sanctions in court or professional discipline, up to & including permanent loss of license to practice

In a January letter, the N.S.F. said that it wanted proposals to sell the buildings and transfer the centerโs two high-flying research aircraft to another federal agency
โHow much will be focused on climate vs weather vs other disciplines?โ said Carlos Javier Martinez, chief climate scientist @ Union of Concerned Scientists & former postdoctoral researcher at the center
โIt feels rushed,โ Dr Martinez said..โI ques if public comment period is of good faithโ
โฌ๏ธ
โOur thinking here was that this is important & we need to save it,โ Rayder said about the observatory. โThese are critical functions. If you are going to break them up, donโt let them go. They need to be kept togetherโ
โฌ๏ธ
Scott Rayder, CEO of Lynker, in Leesburg, VA, that provides space weather forecasts for US military & other fed agencies, said he was submitting proposal to NSF to take over mgt of centerโs High Altitude Observatory, whose scientists study solar flares, space radiation, other atmospheric phenomena

Mr Neguseโs letter to insp gen, whistle-blower confirmed report with employee of an unnamed for-profit co during Jan meeting of the American Meteorological Society in Houston
โI remain deeply concerned about attempts to improperly transfer public assets to private co,โ Mr Neguse wrote
โฌ๏ธ
Mr Neguse said proposals & comments should be made public, intends to press N.S.F. if it refrains
He has asked N.S.F. IG to review allegations by whistle-blower Trump admin officials began negotiating transfer of the centerโs space weather program to private co in Jan, before review was completed
โฌ๏ธ
Reps Joe Neguse-(D),& Jeff Hurd-(R), wrote dismantling center would increase costs & โerode critical research capacity, disrupt longstanding partnerships, diminish ability to understand, anticipate & respond to extreme weather-related risksโ
โฌ๏ธ
โBreaking up inst would have detrimental impactsโ Polis said in statement..โPeople evacuate more quickly, safely from fires because of NCAโ..Centerโs data โimprove severe weather forecasting..fires, floods, support safer aviation, transportation, help businesses/communities make informed decisionsโโฌ๏ธ
Parting fac like a chop shop will be econ blow to CO. Trump feuds with Gov Polis, over Trumpโs pardoning of former CO election official (Tina Peters-R-conspiracy theorist) convicted of multiple state felonies after giving Trumpโs supporters unauthorized access to voting machines post '20 pres electโฌ๏ธ
Michael England, a spokesman for N.S.F., overseeing the center, said proposals & comments from interested parties would not be made public. He would not say when the officials would make final decision about fate of the center.
COโs officials have been fighting to preserve the center
โฌ๏ธ
Proposals are due on Fri to the Nat'l Science Foundation from institutions that want to take over management of the centerโs research portfolio & various facilities; comments from the public about the centerโs future are also due thenโฌ๏ธ
Centerโs staff of 830 employees work under the Univ Corp for Atmospheric Research, nonprofit consortium of colleges & univs
Center also operates supercomputer known as Derecho, in Cheyenne, WY, scientists use to predict wildfires, space weather, hurricanes, other complex weather pattern behavior
โฌ๏ธ
Scientists say move to dismantle center will weaken research crucial to understanding the atmosphere, space, oceans, air pollution & climate change. It will leave emergency officials & planners less prepared for extreme weather events
โฌ๏ธ
The center, founded in 1960, is responsible for many of biggest scientific advances in understanding weather & climate. Its research aircraft, sophisticated computer models of the Earthโs atmosphere & oceans are widely used in forecasting weather events & disasters
โฌ๏ธ
The lab, Nat'l Center for Atmospheric Research, has been targeted for mos by the Trump admin. In soc media post in Dec, Russell Vought, WH budget dir (& an author of Project 2025) called the CO center โone of the largest sources of climate alarmism in countryโ
