According to publicly available data on USAspending.gov, the contract was awarded to "procure the renovation of existing, ICE-owned permanent structure in Surprise, AZ to serve as a processing and detention facility and provide all necessary wraparound services for operation of the facility'" This was done without any local input or the slightest concern for the surrounding community. The decision to convert a warehouse not designed or zoned for human habitation into a large-scale detention facility on an expedited basis raises profound questions about contractor qualifications, concern for human health and safety, and the humane treatment of individuals who will be held there. We are greatly concerned by reporting that GardaWorld, a security contractor, has never been directly contracted to oversee any detention facility but nevertheless has been awarded this significant contract. Furthermore, the contract was awarded through a Department of Defense procurement system, bypassing a normal bidding process that would have ensured community buy-in and necessary due diligence. These facts raise many questions.

Accordingly, we request written responses to each of the following questions no later than fifteen (15) business days from receipt of this letter. 1. What market research was conducted to determine whether other qualified contractors could have met the government's requirements for this facility? Why was a competitive procurement process not deemed feasible or appropriate, and who made that decision? 2. Provide a full accounting of the total contract value, a cost breakdown by line item, and any ceiling on expenditures, along with a written explanation of how the government determined that GardaWorld's pricing represents fair and reasonable value to taxpayers. 3. What performance standards, contractual milestones, and penalty provisions has DHS built into the Garda World contract to ensure accountability for compliance with detention standards? 4. What DHS or ICE components will have direct oversight responsibility for GardaWorld's performance, and what is the oversight staffing plan for a 1,500-bed operation? 5. Does GardaWorld intend to subcontract any portion of the construction, staffing, medical services, or facility management?
