Good point. I would envision a system where the regulators would be able to immediately stop asserted illegal activity but with the ability of the person charged to challenge the charge in an Article III court. Kinda like a challenge to a referee ruling in American football.

The US Federal government is not functioning well. Getting money, lobbying, and corruption out of the government would go a long way towards fixing the problem. Also, creating an independent branch whose sole job is to make sure the government follows the Constitution and the laws would help. IMHO
