The confirmation of charges hearing is not the trial. It is the stage at which ICC judges assess whether there are substantial grounds to believe the accused committed the crimes charged.
If charges are confirmed, the case moves to trial.
Former President of the Philippines, Rodrigo Duterte, is suspected of the crimes against humanity of murder and attempted murder, allegedly committed in the Philippines between 1 November 2011 and 16 March 2019 in the context of the so-called โwar on drugsโ.

The confirmation of charges hearing in The Prosecutor v. Rodrigo Roa Duterte is scheduled to open on 23 February 2026 at 10:00 (The Hague local time) before Pre-Trial Chamber I of the International Criminal Court.

โWithout effective cooperation, the investigation will continue to stall, courtrooms will remain empty, and notably, victims will lose out. Nearly 15 years after the Security Council referral, victims in Libya deserve justice," stated Yasmina Gourchane, former CICC New York Representative.
For victims, cooperation determines whether access to justice is real or out of reach:
โWe want to make our voices heard: we are seeking justice through the International Criminal Court, after losing hope in the Attorney General and the Libyan courts controlled by militias.โ
As @lcw.ngo Director Ali Omar explains:
โCooperation with the ICC in the Libya file remains subject to shifting political and security considerations and the absence of a unified and firm stance by states regarding the execution of arrest warrants undermines victimsโ trust."
In 2025, the path of accountability in Libya was shaped by two events:
๐ด January 2025: Italian authorities release Osama Elmasry Njeem after briefly detaining him under an ICC warrant.
๐ด 1 December 2025: German authorities surrender Khaled Mohamed Ali El-Hishri (Al-Buti) to the ICC's custody.

Non-cooperation compromises the Courtโs ability to fulfill its mandate.
Itโs an especially relevant theme to discuss this year, following non-cooperation by States Parties in 3๏ธโฃ situations: Libya ๐ฑ๐พ, Palestine ๐ต๐ธ and Ukraine ๐บ๐ฆ

Adequate financial support safeguards the Courtโs independence and allows the Court to meet its growing workload and bring justice to victims around the world.
2026โs proposal is anchored in the ICC Strategic Plan (2026โ2029) and takes systemic risks like security threats and cyberattacks.
The budget calls for resilience investments to support the Court through volatile times.

The proposed budget for 2026 (~โฌ197.5 million) is a 1.1% increase from 2025โs budget.
Itโs a much smaller increase than in the last three years, which were all over 10%
