With all these options remaining, why does the fate of thousands of criminal prosecutions in this District potentially rest on the legitimacy of an unprecedented and byzantine leadership structure? The Government tells us: the President doesnβt like that he cannot simply appoint whomever he wants. Notwithstanding the chaos that pervades criminal prosecutions in this District, and without regard to the possibility that scores of dangerous criminals could have their cases dismissed or convictions eventually reversed, βthe [E]xecutive branch, at least right now, is not prepared to . . . use [the legal] options.
A federal judge STRIKES DOWN the District of N.J.βs post-Alina Habba regime, consisting of a βtriumvirateβ of so-called βspecial attorneys.β
Judge Brannβs blistering opinion warns that βscores of dangerous criminalsβ can have their convictions reversed if Trump insists on illegal appointments.
Let's talk about it sometime soon!
Today, Clayton is in control at SDNY, and the Halkbank case appears to be heading to an out-of-court resolution as Trump appears to have neutralized SDNY's famed independence from Main Justice.
Berman resisted pressure from then-AG Bill Barr to dismiss the case.
Barr wanted to fire Berman and replace him with ex-SEC chairman Jay Clayton.
Finding Clayton inexperienced, Berman refused to leave unless replaced with his deputy Audrey Strauss, who took over and kept the case alive.
After that effort failed, Zarrab turned state's witness against Halkbank manager Hakan Atilla and implicated Erdogan in sanctions-busting trades.
That case led to separate indictment against Halkbank itself, eventually led by one of Bharara's successors Geoffrey Berman.
This is a case where multiple ex-SDNY U.S. Attorneys suspected that Trump's White House tried to kill the case.
It began when @preetbharara.bsky.social charged Turkish-Iranian gold trader Reza Zarrab with spearheading the scheme.
Rudy Giuliani repped Zarrab and tried to execute a prisoner swap.

Trump DOJ offers a deferred prosecution agreement to Halkbank, the Turkish state-run bank charged with laundering billions in Iranian oil money.
Trump repeatedly tried to end this case in his first termβper John Bolton, as a favor to one of the "dictators he liked" (i.e. Erdogan).

JUSTICE GORSUCH: Can you give me a reason to accept it, though? That's what I'm struggling and waiting for. What's the reason to accept the notion that Congress can hand off the power to declare war to the President? GENERAL SAUER: Well, we don't contend that. Again, that would be -- JUSTICE GORSUCH: Well, you do. You say it's unreviewable, that there's no manageable standard, nothing to be done. And now you're -- I think you -- tell me if I'm wrong. You've backed off that position. GENERAL SAUER: Maybe that's fair to say.
JUSTICE GORSUCH: You're saying there's inherent authority in foreign affairs, all foreign affairs, so regulate commerce, duties and -- and -- and -- and tariffs and war. It's inherent authority all the way down, you say. Fine. Congress decides tomorrow, well, we're tired of this legislating business. We're just going to hand it all off to the President. What would stop Congress from doing that? GENERAL SAUER: That would be different than a situation where there are metes and bounds, so to speak. It would be a wholesale abdication.

The Trump administration wonβt seek an appeal of the dismissal of the so-called death-eligible counts against Luigi Mangione.

New: As David Ellison prepares to take control of CNN, legendary CBS News producer Mary Walsh, who is exiting, sent a goodbye note to colleagues.
In the note, Walsh writes, "Weβve been told to aim our reporting at a particular part of the political spectrum. Honestly, I donβt know how to do that."
