Equal protection and due process are the more obvious arguments, and those arguments should prevail before a non-fascist judiciary, but reading this decision from the EU shows that there are SO MANY PATHS to reaching the clear conclusion that Kansas is acting unconstitutionally.

The logic here—that the EU “right to move” will be hindered by a member state denying a passport gender change—strikes me as a compelling explanation of (one reason) why Kansas revoking licenses was unconstitutional. It burdens the right to travel under US privileges and immunities clause.

Other parties who object to the appropriateness of ballot questions sue the Attorney General for approving the question and the SJC has jurisdiction to consider the question. Here, it would look bad for the legislature to do so, and would only strengthen the arguments of those seeking to reform it.

This seems like the key to understanding why the Senate would seek an advisory opinion rather than suing the AG: “su[ing] to block a ballot question from advancing…could give ballot question proponents more ammunition to paint Beacon Hill as an opaque fiefdom in need of outside reform.”

For contentious records, like those he has been seeking from District Attorney Sullivan’s office, it takes actual litigation, with all the costs associated. Attorneys' fee shifting doesn't go far enough; if we want a transparent, accountable government, prevailing requesters should receive bounties.

Saw this piece after reading the SJC case this morning: massdump.ghost.io/breaking-the... . @andrewqmr.bsky.social is absolutely right about the problems of enforcement. You generally need either the AG to act or a credible threat of litigation to get even relatively innocuous public records in MA.
