I completely understand this but I've also seen achievements turn a shallow experience about nothing into a game about something. And I've also seen them used brilliantly like in Knytt Underground where they are given for simply standing on hard-to-reach platforms which had no other purposes.
But in general, there is still a larger conversation to be had. Let's consider another analogy to music, like VGM which sounds like "real music" which was made with no permissions. Or the countless instances of legally distinct sound-alikes. Why is visual art so much easier to attack?
I understand, and addressed how it pertained to this particular free fan game which already included graphics, sounds, characters, and stories from other peoples' works, and how it only needed to mimic stock imagery or what is already considered "low art".
