Yea, I think if they had minimum disbursement it would curb a lot of systematic behavior. But generally I think I'd just prefer everything get taxed even the donations at this point, rather than rely on any kind of investigations and punishment for misuse. (I say this as someone who donates a lot!)

Yea in theory but in practice people like Elon break 100 laws a day. You are right that there is an existing law against self dealing and there is also a fairly widespread belief that Elon uses his DAF liquidity to buy TSLA calls. The SEC stopped enforcing the law on him years ago.
