After the TACO, Iran will remove them if Trump sticks to whatever deal works out.

The US Navy has refused near-daily requests from the shipping industry for military escorts through the Strait of Hormuz since the start of the war on Iran, saying the risk of attacks is too high for now.

This spells continued disruption to Middle East oil exports and diverges from Trump’s words.

No, Trump will TACO. He's got no other option. The oligarchs will destroy him otherwise.

Yes, exactly. We can still have ideals, but we must acknowledge that some people will abuse the kindness and openness of our society.

The Court is a political institution. The justices are partisans in robes. The quicker liberals view it as a political institution, the quicker we can get to reforming it.

Surely, this will make him want to compromise!

We have the right to demand smarter and tougher Democrats who don't naively compromise with Republicans.

You can continue your Manchin boosting on your own dime.

A three-panel Simpsons meme using the β€œMoe throws out Barney” template.

In the first panel, Moe slams Barney against the wall, labeled β€œAyatollah Khomeini,” representing Trump’s airstrikes killing the Iranian Supreme Leader.

In the second panel, Moe pauses with a look of momentary satisfaction.

In the third panel, Moe throws Barney back in through the door into the rain, again labeled β€œAyatollah Khomeini” β€” representing Iran naming Khomeini’s son as the new Supreme Leader, suggesting the problem has simply returned in a new form.

The meme satirizes the futility of Donald Netanyahu's airstrikes, as Iran's theocratic leadership continues regardless.

Trump's Iran policy, explained.

They actually imagined that judging wasn't politics. It was delusion. And these people were the premier legal instructors.

In contrast, most of today's top constitutional scholars came of age in the heyday of the Supreme Court's popularity.

"The people who taught us were all Warren Court people," said Pam Karlan, a constitutional and voting-rights expert at Stanford law school, referring to Chief Justice Earl Warren, who
through the 1950s and 1960s led a court of both Democratic and Republican appointees to expand civil rights, equalize political representation and liberalize the criminal justice system. "They'd clerked on that court. They valorized it. There was this notion that judges were these heroes who would save us all.

Our students do not have that view."

Rebecca Brown, at the University of Southern California, has been teaching constitutional law for 35 years. "While I was working on my syllabus for this course, I literally burst into tears," she told me. "I couldn't figure out how any of this makes sense. Why do we respect it? Why do we do any of it? I'm feeling very depleted by having to teach it."

Many professors of constitutional law have been utterly delusional about what courts do. This is a decades-long trend noted in the New York Times piece I referenced in the episode.

It's actually disturbing to read their naivety. web.archive.org/web/20240226...

You should read the NYT article I link in the intro if you think legal formalism isn't common in liberal legal circles.

This episode isn't about voters or elections. It's about legal philosophy and how Democrats regard the court. Even now, they barely mention it compared to Republicans before the Roberts court.

Apparently you haven't heard of logical positivism or legal formalism.

It's amazing that somehow, always, there's no way to ever expect Democrats to any more aggressively against fascism. No, they do no wrong, and we must never expect them to adopt better thoughts and actions.

You should get your nose checked then. Constructive criticism rather than nihilist whining or blank checks is what Democrats need to oppose Trump better.

One of my favs for sure.

A thing I forgot to say is that the broader left didn't realize that conservatives had only temporarily learned that aiding fascism is a dangerous idea.

As the WWII-era conservatives slowly faded away, the hard-fought lesson they learned was forgotten by the right.

Assenting to Trump's insane Iran war would mean accepting a broken and malevolent vision of America Democrats who are considering funding the illegal attack on Iran risk tossing the opposition into a moral abyss, while betraying the American people in favor of the president

That's not at all what this is.

Republicans chose to be fascist. We have to choose differently in response. Can't play by outdated rules and delusions of a view from nowhere.

The liberal legal establishment deluded itself that judging was apolitical, America is stuck with the consequences A conversation with The Nation’s Elie Mystal on how legal formalism stopped the left from restraining judicial power

Judging has always been a political profession. But after the Warren Court, the liberal legal establishment deluded itself into thinking that judges were objective gods in black dresses.

All of the things you hate about SCOTUS go back to this horrible error. @elienyc.bsky.social and I discuss:

The Florsheim shoes are this term's double-scoop of ice cream. They seem like something trivial but actually are an important detail of the authoritarian imbecile that Trump is.

Besides gaslighting uninformed people that he was a moderate, Donald Trump has also significantly gaslit millions of informed liberals into defeatism.

Fascism is unpopular. It cannot win without defeatism on the left.
