There is a difference between a court finding a law unlawful, and the Parliament repealing it.
If a Court finds it unlawful, it will *always* have been unlawful, including retroactively. It will, in effect, never have been the law at all.

DVLA has a whole process for informing them if you are - or are a risk of being - impaired due to a medical condition or because you are taking drugs.
You even have to inform them if you are taking insulin for diabetes and that's nowhere near a class A drug!
This is not a new problem.
There are prescription drugs that exist that quite explicitly tell the user not to drive or operate machinery whilst on them. Similarly, this can be a condition of a prescription.
Doctors are already empowered to advise - or even a require - a user not drive whilst under treatment.
