There are several lines of evidence suggesting that this may have been the case - the blatant effort to prevent Lee from becoming president being one.
If Cho was a coconspirator, there must be some pretty clear evidence out there (e.g. minutes of the post-declaration
In other words, Cho wants (or is willing) to send Yoon to jail - given that anything less than that would enrage the public and probably undermine the foundations of the judiciary itself - and yet needs to maintain the legality of the Martial Law Declaration because the Cho court was a coconspirator
in order to send Yoon to jail.
In other words:
1) Yoon goes to jail (for sending soldiers in)
2) Declaration of Martial Law is valid (i.e. not a matter for the courts)
Were I to speculate (and with no evidence whatsoever), I would say that Cho Hee-dae's fingerprints are all over this.
What this leaves hanging is the question of whether the ABUSE of martial law powers of the presidency is a matter for the judiciary.
What I find interesting, and I'm no lawyer (Korean or otherwise), is the extent to which Ji is searching for reasons other than possible illegality of martial law
as long as he doesn't send soldiers in - and the judiciary cannot get involved. So, potentially, a future president could declare martial law and arrest politicians in their homes etc, as long as soldiers aren't sent to the NA.
Hence, Yoon got a life sentence for the sin of sending soldiers in, and not for declaring martial law itself.
Korean political commentators are up in arms about this, because this seems to imply that a president has the right to declare martial law with impunity...
So, in short, what Judge Ji Gwi-yun is arguing is that what Yoon did wrong was not so much declaring martial law under the conditions in which he did so. What Yoon did wrong (argues Ji) was send soldiers to the National Assembly and hence put people in harm's way.

Rough translation:
"In principle, the president's emergency martial law declaration cannot, in and of itself, constitute (apply) insurrection, and it is difficult to argue that it can serve as a subject of the judiciary's scrutiny."
No doubt that's what he's counting on. Look at Lee Sang Min's smile. I don't think he believes he'll spend 7 years in jail.

I'm currently on a strict #diet. It turns out that watching mukbang videos actually helps. Rather than wanting to eat food, vicarious eating is making me feel full.

I'm preparing myself to be disappointed.
The #Yoon insurrection verdict will happen on Feb 19 (Thurs) starting at 11 am (that is Feb 18 Wed at 6 pm Pacific Time).
More knowledgeable people than me are predicting a guilty verdict and either a life sentence or the death penalty. I'm less sanguine.
