His men who were shot were tried by field courts-martial applying a simple βfalse uniform -> spies -> executionβ rubric that was contrary to existing US military law, which included essentially the same standard applied in Skorzenyβs trial. Skorzeny himself was tried by a more competent court.
The applicable international law has also changed; Additional Protocol I prohibits any use of false uniforms βto shield, favour, protect, or impede military operationsβ, although Israel does not recognize the Additional Protocol.
The key point behind the Skorzeny verdict was that his troops hadnβt actually *fought* while wearing false uniforms. Much like a ship flying false colours, it was considered a legitimate ruse of war and not perfidy so long as it was dropped before opening fire.
