different places outside CDCal may differ. Here in D.Mass, the Guerrero Orellana class attorneys would say Judge Saris's declaratory judgment "says what the law is" and so a bond hearing entitlement remains here (the Gov. disagrees).

Also an amicus brief from New York, Washington DC, + 19 more states (incl. Massachusetts).

And AIC and AILA have an amicus brief in support of the class:

Oops, they left off the immigration lawyer who represents JosΓ© Guerrero Orellana from the signature block of last night's briefβ¦
OK, burning the midnight oil with an 11:52pm filing for a midnight deadline, here's the ACLU's opposition brief on behalf of petitioners-appellees:

Having finally gotten to minute 41 of this depo (N. Cavanaugh 1/6), I get the impression that Amy Gleason was the administrator of the USDS (US DOGE Service) but *not* of DOGE itself.
Was that a distinction that was previously understood?
Meeting adjourned. 9:18:11pm.
Good night.
We're basically done here.
Apparently resident parking is not coming up tonight.
*Withdrawn.
Unanimous consent was roll-call'd 8-0-1 (AAZ absent).
Withdrawed.
Policy Orders passed without debate.
We're on to Charter Rights.
CZ seeks unanimous consent to withdraw her Cambridge St. Zoning PO.
"The appropriation" is approved 6-2-1.
AAZ had to leave for a religious observance.
Vote: AAZ - BA y TF y MM y PN y EDS y JSW n CZ y SS n
SS: "I'll vote when the vote comes."
but she says that there's a majority in support of the settlement.
(That's kind of a weird hedge!)
PN is back. She doesn't agree with the claims, but thinks supporting the settlement is the fiscally prudent approach.
PN says she needs to talk to the City Solicitor to make sure she can permissibly speak without breaking the executive session / attorney client confidentiality.
EDS notes that in the past she opposed a $4M settlement in the past and the result was a $10M payment.
TF is up. He does seem, unlike others, to have a little more familiarty with the specifics of this lawsuit, which is really about whether Sig Sauer's P320 has a problem with uncommanded discharges.
TF thinks anything other than the settlement would be "improvident and imprudent."
BA responds, engaging JSW, suggesting he doesn't quite see the throughline as to cost.
JSW will oppose the settlement and thinks it'll cost the city "far more money."
Done. Now on to CMA#6, the Ahern v. Sig Sauer settlement for $400,000-ish. Well, transfer of $400,000 to support the settlement.
Done. CMA#5, Housing and Zoning priorities.
On to $256,000 from Mass *Save.
[not Mass Ave, oops.]
Done with ratings, on to Green Jobs.
(We are on the bond rating agencies' reports as to Cambridge's continuing Aaa status (Moody's) or AAA (Fitch, S&P).)
The Housing Dept. is approved 8-0-1 (EDS absent).
Now back to the regular meeting.
And here are the two amicus briefs.
FAIR's in support of the Government: www.documentcloud.org/documents/27...
and the former judges in support of plaintiff-appellees:
www.documentcloud.org/documents/27...
Here's the Government's opening brief from Feb. 17:
www.documentcloud.org/documents/27...
Also, there have been two amici so far.
The Federation for American Immigration Reform last month and a group of "former immigration judges and appellate immigration judges" today.
The First Circuit has beenβ¦annoying and refused to lift the immigration docket access restrictionsβ¦except for me personally somehow? (I do not understand this.)
On Jan. 30 the ACLU moved to consolidate the two Guerrero Orellana appeals (the individual appeal and the class action appeal), and on Feb. 2 the First Circuit set a briefing schedule:
β’ Opening brief Feb. 17
β’ Response brief March 9 (today)
β’Β Reply brief March 16
OK, so, I haven't talked much about the Guerrero Orellana class action appeal. I'll try to do some of that now/here.
